Terms of use

This translation is provided for understanding. The French version is the legally binding one.

1. Acceptance of the terms

By creating an account on app.synthcraft.dev, you accept these terms as well as the annex on data processing, which forms an integral part of them. The date, the version accepted and the email address are recorded when the account is created.

The service is intended exclusively for professionals. If you accept these terms on behalf of a company, you declare that you have the authority to do so.

2. Description of the service

Synthcraft Web & Automation is a SaaS platform made up of independent services:

  • Conversational agent — an AI agent on your website and, depending on your configuration, on WhatsApp.
  • Voice agent — an AI agent that answers the phone on a dedicated Swiss line, included in the subscription and put into service by us.
  • Online booking — a scheduling widget synced to your calendar.
  • Prescription follow-up — questionnaire, collection of consent and renewal request to the doctor.

The answers are produced by language models. They may contain errors: the service is a support tool and replaces neither your professional judgement nor medical, legal or financial advice.

3. Account and access

  • You are responsible for keeping your credentials confidential and for actions carried out from your account.
  • You undertake to provide accurate information and to keep it up to date.
  • You are responsible for the content you give the agent (knowledge, prices, opening hours) and for its accuracy.
  • Any attempt at unauthorised access leads to immediate termination of the account.

4. Telephone line

The Swiss line attached to the voice agent is put into service, held and paid for by Synthcraft; its rental and incoming calls are included in the subscription. It is made available to you for the term of the contract and is not transferred to you: on termination, the line is returned and the number may be reassigned. Your own numbers stay with your operator, in your name, and are unaffected.

5. Call recording

Calls handled by the voice agent are recorded and transcribed, and made available to you in your dashboard. The agent announces the recording in its opening sentence, in accordance with art. 179ter of the Swiss Criminal Code. You undertake not to remove that announcement if you customise the greeting; the system restores it automatically when it is missing.

Recordings are kept for 90 days, then deleted. Summaries and transcripts are kept for the term of the contract. You can delete a call at any time from the dashboard.

6. Subscription, quotas and payment

  • Subscriptions are billed monthly through Stripe and renew automatically.
  • Prices are shown in CHF. VAT does not apply; should it become applicable, it would be added to the prices shown.
  • Each service includes monthly quotas (messages, call minutes, SMS). You are warned before reaching the limit; beyond it, the service concerned is suspended until renewal or until extra credit is purchased. No overage is ever billed automatically.
  • Extra credit purchased is valid for the current month and is not refundable.
  • You may cancel at any time from the dashboard; cancellation takes effect at the end of the current period.
  • No refund is granted for periods already started, unless required by law.
  • Where a preferential rate has been granted for a fixed period, the list price applies automatically when it ends.

7. Acceptable use

It is forbidden to use the service to:

  • distribute unlawful, discriminatory or misleading content;
  • automate spam, unsolicited cold outreach or harassment;
  • pass the agent off as a human when the person you are speaking to asks;
  • circumvent security, quota or billing mechanisms;
  • process health data without a legal basis and without informing the people concerned.

8. Intellectual property

The code, the interfaces and the Synthcraft Web & Automation brand remain our exclusive property. Your data — conversations, calls, documents, leads, appointments — belongs to you. We use it neither for commercial purposes nor to train models.

9. Availability

We aim for 99.5 % availability outside planned maintenance, announced 24 hours in advance. The service depends on third-party providers (telephony, language models, calendar); an outage at one of them may affect some or all of the services.

10. Limitation of liability

We are not liable for indirect loss, loss of profit, or the consequences of an incorrect answer from the agent, a missed appointment or a call that did not go through. Our total liability is limited to the amounts actually paid over the last three months. These limits do not apply in the event of wilful misconduct or gross negligence.

11. Changes

We may change these terms with 30 days’ notice given by email. Continuing to use the service after that period constitutes acceptance. Each version is identified by its date.

12. Governing law

Swiss law. Exclusive jurisdiction: the courts of the Canton of Vaud, subject to mandatory places of jurisdiction.

Annex — Processing of personal data

Data processing agreement within the meaning of art. 9 FADP. Forms an integral part of these terms.

A1. Roles

You are the controller of your clients’ and patients’ data. Synthcraft acts as processor and processes that data only on your instructions and in order to provide you with the service.

A2. Subject matter, duration and categories

  • Subject matter: answering your clients’ requests, booking appointments, passing enquiries on to you.
  • Duration: the term of the contract.
  • Data subjects: your clients, patients and prospects.
  • Data: identity and contact details, content of written conversations, call recordings and transcripts, appointments. Depending on your activity, this data may reveal sensitive data within the meaning of the FADP, in particular relating to health.

A3. Our commitments

  • Process the data only to provide the service, never for our own purposes, and never to train models.
  • Bind every authorised person by a confidentiality commitment, including — where you are subject to professional secrecy (art. 321 SCC) — as an auxiliary bound by the same secrecy.
  • Implement appropriate technical measures: encryption in transit and at rest, separation per client, administrator access reserved to the operator.
  • Assist you in handling access, rectification and deletion requests.
  • Notify you without delay, and at the latest within 48 hours, of any data security breach we become aware of.
  • At the end of the contract, delete the data or return it to you on written request made within 30 days.

A4. Sub-processors

You authorise the use of the providers necessary for the service. As of today: Supabase (hosting, EU), Vercel (application), Anthropic (language model), OpenAI (knowledge-base search), Vapi, Twilio (telephony and SMS), Deepgram (transcription), Microsoft Azure (speech synthesis), Resend (email), Cal.com (calendar), Meta (WhatsApp, if enabled), Stripe (payments), Sentry (technical error log), Upstash (rate limiting). Several of these providers process data in the United States, in particular for calls; these disclosures are covered, in accordance with Art. 16 FADP, by the Swiss-U.S. Data Privacy Framework or by standard contractual clauses. The list above is authoritative and kept up to date; any change is notified to you 30 days in advance and you may cancel free of charge if you refuse it.

A5. Location and retention

The database is hosted in the European Union; calls and the agents' replies are processed by the providers listed in A4, in particular in the United States. Call recordings are kept for 90 days; other data for the term of the contract.

A6. Audit

On written and reasoned request, and at most once a year, we provide you with the information necessary to demonstrate compliance with this annex.
